In response to a complaint by the Austrian data rights activist Max Schrems, the Court of Justice of the European Union declared the EU-USA data protection agreement “Privacy Shield” invalid on 16 July 2020. This means that the second agreement on the protection of personal data of EU citizens in the USA has already failed after the “Safe Harbour” agreement was stopped about five years ago. But what does this mean for companies?
Anyone who has processed data solely on the basis of the Privacy Shield must switch to standard contractual clauses – otherwise there is a risk of data chaos and legal uncertainty, complains the German industry association BITKOM. The German Federal Association of IT Users VOICE (German only), which represents CIOs in Germany, states that it is illegal to transfer personal data to the USA on the basis of the Privacy Shield. The association also points out that even standard contract clauses are now legally controversial. But how are European companies supposed to guarantee the transfer of personal data to the USA, which is sometimes necessary for their existence, or to protect themselves against an outflow of data to the USA?
