EU Citizens have a new Privacy Shield

The EU-U.S. Privacy Shield Framework was adopted last month, July 2016. This new regulation was designed and accepted by the U.S. Department of Commerce and European Commission to provide companies on both sides of the Atlantic with a mechanism to comply with EU data protection. The Privacy Shield’s requirements impacts personal data being transferred from the European Union to the United States*. Safe Harbor was in effect until October 6, 2015 when the Court of Justice of the European Union (CJEU) invalidated the Safe Harbor Framework. Privacy Shield will replace the Safe Harbor Framework. US Companies that do global business may be interested in being in compliance, if they receive personal data from European Union citizens. A U.S.-based company will be able to self-certify to the Department of Commerce and publicly commit to comply with the Framework’s requirements. Joining the Privacy Shield Framework requirements are voluntary, however once a company makes a commitment to comply they must follow and maintain these key requirements: • Informing individuals about data processing • Providing free and accessible dispute resolution • Cooperating with the Department of Commerce • Maintaining data integrity and purpose limitation • Transparency related to enforcement actions • Ensuring commitments are kept as long as data is held See https://www.commerce.gov/page/eu-us-privacy-shield for details about the Privacy Shield regulations. As is the case with any regulation, it is not without disagreement, it remains to be seen if US Companies will adopt this new regulation and if it does in fact safeguards the people and their data.
